Trademark registration can be obtained for brands, words, logo, numerals, slogan, devices, etc. It can also be obtained for a business name, captions or taglines. It gives the owner a legal right to use that expression exclusively for his/her trade.A trademark of a product or service distinguishes it from others and a properly used and promoted Trademark may become the most valuable asset of a business.
In India trademarks are registered under the Trademarks Act, by the Registrar of Trademark. It gives the right to registered trade mark owner to sue for damages when infringements of trademarks occur.
Use of TM, SM and ® Symbols
'TM' stands for Trademark and 'SM' stands for Servicemark. On filing of trademark application, the applicant can use TM and SM symbols to notify the public that the company is claiming exclusive ownership of the trademark.
Further ® symbol, can be used only once the trademark is registered and the registration certificate is issued. Also, it can be used only in connection with the goods and/or services with respect to which trademark has been registered.
Registration process for both trademarks and servicemarks is same.
