Trademark registration can be obtained for brands, words, logo, numerals, slogan, devices, etc. It can also be obtained for a business name, captions or taglines.It gives the owner a legal right to use that expression exclusively for his/her trade.A trademark of a product or service distinguishes it from others and a properly used and promoted Trademark may become the most valuable asset of a business.

In India trademarks are registered under the Trademarks Act, by the Registrar of Trademark. It gives the right to registered trade mark owner to sue for damages when infringements of trademarks occur.

Use of TM, SM and ® Symbols

'TM' stands for Trademark and 'SM' stands for Servicemark. On filing of trademark application, the applicant can use TM and SM symbols to notify the public that the company is claiming exclusive ownership of the trademark.

Further ® symbol, can be used only once the trademark is registered and the registration certificate is issued. Also, it can be used only in connection with the goods and/or services with respect to which trademark has been registered.

: What trademark applications are commonly rejected?

If your trademark is similar to an existing application, would hurt religious sentiments, contains geographical names or common words. It would also be rejected if it is likely to cause confusion. So you can't register the word 'car' for a car brand, but may do so for a brand of electronics.

: What are the documents required for trademark registration?

A copy of the trademark to be registered along with the address and identity proof of the trademark owner is required. In case of Company, the name of the Company along with its Certificate of Incorporation and Address proof is required.

: Do you guarantee approval of my trademark?

It depends entirely on the government's judgment. But if it is unique, it is highly likely that it will be granted.
